Abstract

Serangan rumah sakit di wilayah Palestina adalah kejahatan berdasarkan Hukum Humaniter Internasional dan belum ada seorang pun yang diadili atas kejahatan ini dan perang selama 76 tahun telah menjadi tidak terkendali sehingga mengakibatkan korban perang bagi warga sipil dan anak-anak Palestina. Tujuan dari penelitian ini difokuskan untuk mencari tahu mengapa Dewan Keamanan PBB tidak melakukan penegakan Hukum Internasional dengan mengadili mereka yang bertanggung jawab atas penyerangan rumah sakit di Palestina. dan Untuk mengetahui Peran Hukum Internasional dalam Perang Palestina-Israel, metode yuridis normatif merupakan metode untuk mengetahui permasalahan dalam penelitian ini dengan pendekatan kasus dan pendekatan sejarah hukum. Kajian ini menyimpulkan bahwa hak veto Dewan Keamanan PBB patut dipertimbangkan kembali sebagai syarat utama bagi ICC untuk mengadili kejahatan perang dan kemanusiaan yang dilakukan dalam konflik Palestina dan Israel dengan dibuktikan melalui ilmu pengetahuan ilmiah.
